A policeman accused of attacking a G20 protester with a metal baton was cleared yesterday after the alleged victim failed to turn up to court. Prosecutors were facing questions last night over why the case – said to have cost up to £100,000 – was allowed to continue when the key witness refused to testify. Metropolitan Police Sergeant Delroy ‘Tony’ Smellie was accused of beating Nicola Fisher during London demonstrations on April 2 last year.

The riot squad officer, 47, was charged after demonstrators posted YouTube footage of him appearing to strike the animal rights activist, leaving her with 7in bruises on her leg. When quizzed by the police watchdog, Sgt Smellie said he had lashed out because he believed a carton of juice she was carrying posed a threat.
